Procedure For Importation
According to Section 13 (1) of the Malaysian Timber Industry Board (Incorporation) Act 1973 [Act 105], MTIB is responsible for regulating the country's timber industry activities which includes the requirement for timber product import activities to be registered with MTIB. Additionally, MTIB has been authorized by the Jabatan Kastam Diraja Malaysia (JKDM) to issue import permits for timber and timber products in line with the provisions under the Customs Act 1967, Customs (Prohibition of Imports) Order 2023, Second Schedule, Part I, Paragraph 4, Item 2 [P.U.(A) 117], gazetted on April 13, 2023.

MANDATORY DOCUMENTS |

1. The applicant must submit a complete (latest) company profile search from the SSM e-info system (Companies Commission of Malaysia). 2. Copy of the latest Company Winding Up Status and Individual Bankruptcy Status search for all company directors / business owners (the latest) from the Malaysian Department of Insolvency. 3. The applicant must have a valid business registration certificate under the Business Registration Act 1956 [Act 197], Partnership Act 1961 [Act 135], or Companies Act 2016 [Act 777]. 4. The applicant must submit the importer registration form, including a completed sworn affidavit; Refer to Importer Form. 5. Copies of identification documents (identity card/passport) for all company directors (Sdn. Bhd. companies) or business owners and partners (sole proprietorships / partnerships) or individuals (Graders and Operators). 6. Supporting documents proving the company's current address. For example, a copy of the utility bill for the company's current premises address, etc. (exempted for Graders and Operators) |

7. The timber to be imported must be timber listed under the First Schedule to Act 105. 8. Applicants who do not have a factory must first register as a Trader. 9. If the timber to be imported is for the domestic market the applicant must first register as a Trader. 10. If the timber to be imported is for re-export, the applicant must first register as a Supplier |

i. Complete registration applications will be approved. ii. The company will receive an Approval Letter to import for a period of one (1) year from the date the letter is issued. |
i. Complete applications will be brought to the Import and Export Committee Meeting (MJIE). ii. Upon receiving MJIE approval, the company will receive an Approval Letter to Import for a period of one (1) year from the date of the letter, along with the total quantity allowed for import. |
STEP 2: IMPORT PERMIT APPLICATION AND PHYSICAL INSPECTION |

Once the timber and wood product consignment arrive at the authorized entry point, port, or landing site, the importer needs to submit an import permit application to any nearby MTIB Regional Office, bringing the following documents: 1. Valid Approval Letter to import. 2. Valid Certificate of Origin (COO)/Form D from the exporting country. 3. Invoice. 4. Packing lists. 5. Bill of lading. 6. "Legality" documents, such as: · FLEGT License; or · Certificate of Timber Certification (PEFC, MTCS); or · Certificate of Voluntary Legality Scheme; or · Legality Document issued by a recognized Agency/Body/Association; or · Self-Declaration certified by a qualified Third Party; or · Copy of the Customs Declaration from the exporting country. |

FOR IMPORTING ENDANGERED TIMBER SPECIES LISTED IN THE THIRD SCHEDULE, ACT 686 The Export CITES Permit from the exporting country must be submitted to MTIB in advance to obtain verification from the producing country regarding the permit before the CITES Import Permit is issued by MTIB.

STEP 3: PHYSICAL INSPECTION OF TIMBER CONSIGNMENT |

1. Random inspection of the import permit and declaration of the timber consignment will be conducted. 2. Physical inspection will take place at the location of the timber consignment. 3. Approved timber consignments will be stamped "Inspected". Importers can proceed with direct declaration to Customs. 4. Approved timber consignments that were not inspected will be stamped "Approved Without Physical Inspection". Importers can proceed with direct declaration to Customs. 5. For physical inspections that are not approved, the importer must make a complete re-declaration, and a thorough inspection will be carried out. |

If the declaration is still found to be incorrect, enforcement action will be taken to detain the timber consignment. |

STEP 4: REQUIREMENTS FOR COMPLIANCE WITH OTHER AGENCY REGULATIONS |

Importers must comply with regulations enforced by the Department of Agriculture (DoA) by applying for an import permit for quarantine inspection and Phytosanitary Certificate verification, as well as providing the scientific name of the timber. |

Importers also need to obtain approval from the State Forestry Department for royalty payments and the issuance of a Replacement Pass for transferring forest produce. |
Jabatan Kastam Diraja Malaysia (JKDM) will ensure all requirements and regulations have been implemented before granting clearance for import permits for the following timber products in Peninsular Malaysia and the Federal Territories (Kuala Lumpur and Labuan).
